1. Acceptance of Terms

By downloading, installing, accessing or using the CabinetCost application (the"App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms are a legal agreement between you and BuildEffective, Inc. ("BuildEffective", "we", "us" or "our").

2. Description of Service

CabinetCost is a tablet application designed to help users estimate cabinetry installation costs for different spaces within a property. The App allows users to add spaces, capture dimensions, select cabinet styles, materials, finishes, frames and other options, and generate PDF estimates that can be shared with others.

The App is provided 100% free of charge. We do not currently charge fees for downloading or using the core features of CabinetCost.

3. License to Use

Subject to your compliance with these Terms, BuildEffective grants you a limited, non-exclusive, non-transferable, revocable license to download, install and use the App for your personal or internal business purposes on compatible devices that you own or control.

4. Restrictions

You may not: (a) copy, modify, translate or create derivative works of the App; (b) reverse-engineer, decompile, disassemble or otherwise attempt to discover the source code of the App; (c) rent, lease, sell, sublicense or distribute the App; (d) remove any proprietary notices or labels; (e) interfere with or disrupt the integrity or performance of the App; or (f) use the App for any unlawful purpose.

5. Intellectual Property

All content, features, functionality, designs, code, trademarks, service marks and other intellectual property in or associated with CabinetCost are owned by BuildEffective, Inc. or its licensors. Nothing in these Terms grants you any right to use our trademarks, logos or branding without our prior written consent.

6. User Content

You retain ownership of any estimates, measurements, notes and other content you create using the App ("User Content"). You grant BuildEffective a limited license to process and store your User Content solely for the purpose of operating the App and providing its features to you.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, secure or that any estimates generated are accurate, complete or suitable for your specific project. Estimates produced by the App are for informational purposes only and should be verified independently before making financial or construction decisions.

8. Limitation of Liability

To the maximum extent permitted by law, BuildEffective, Inc. and its officers, directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of or inability to use the App.

9. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after the changes become effective constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, U.S.A., without regard to its conflict-of-law principles.
